Product Safety Organization Cites Dismal Effectiveness of Children's Product Recalls

March 29, 2016 | Category: Product Liability

According to a 2015 report by Kids in Danger (KID) about one-quarter of all products recalled by the Consumer Products Safety Commission (CPSC) in the prior year were children's products. Like KID, each Los Angeles product liability attorney at our firm was heartened by a slight reduction in product-related child injuries and fatalities. However, a great concern remains that nearly 80 percent of recalled children's products are still in consumers' hands.

Recalls for Children's Products Do Not Easily Reach Consumers

It is seldom a secret when individuals purchase cars. These high-ticket purchases generally involve everything from credit checks to license applications, so in the event of a recall, it is generally a simple matter to notify consumers about a recall and what to do to correct it.

Children's products, on the other hand, are not generally high-ticket items. In fact, the majority of 2014 recalls involved the following items:

  • Clothing (33 percent)
  • Toys (25 percent)
  • Nursery (23 percent)
  • Furniture (11 percent)

Most of these items do not come with registration card options, and few consumers would register these types of products if given the opportunity to do so. The good news is that some parents can potentially hear about dangerous products thanks to the popularity of social media. Parents can also sign up to receive children's product recall notifications by email from SafeKids.org, which compiles information from many sources to help provide the comprehensive information that parents need.

After Injuries, Recalls Do Not Automatically Provide a Defense for Manufacturers

Consider the number of new clothing items that growing children get each year, and then think about how quickly they outgrow toys, as well. Is it reasonable to expect parents to stay on top of recalls issued for such a large volume of products? In the event that a child sustains injuries, a manufacturer is likely to try to use an existing recall as a valid defense in a legal case.

An experienced personal injury attorney is likely to see things quite differently. Just as important, with evidence to support a compelling case, judges and juries are likely to recognize the true liable parties in cases pertaining to children who suffer injuries caused by unsafe products.

Parents should not have to pay out of pocket when their children sustain injuries caused by poorly-designed or defective products. I would like to post the highest possible recommendation of Jeffrey Rudman. Jeffrey was very successful in fighting for my rights and did everything possible to brilliantly win a hotly contested jury trial. He was very open in discussing and planning every aspect of the case, and gave all the pro's and cons for every decision at every step of the way.
